SPECIAL COMMISSION MTG DICKINSON CITY COMMISSION MAY 30, 2023 1. CALL TO ORDER President Scott Decker called the meeting to order at 8:00 AM. 2. ROLL CALL Present were: President Scott Decker, Vice President John Odermann, Commissioners Jason Fridrich, Suzi Sobolik and Robert Baer 3. ADMINISTRATION 1. Chapter 4 Amendment City Administrator Dustin Dassinger presents for a second reading Chapter 4 to include the concession liquor license for Legacy Square. He states this amendment to Chapter 4 includes a separate license to be bid annually in October; Class A and Lodge/Clubs will be the only license holders to be able to bit on the concession license. This license will be non-transferrable and used for city sponsored events. Only beer in cans and wine will be able to sell at the events. There will be no glass bottles. There will be a designated corridor for the license. President Scott Decker states caterers will not be able to sell alcohol during these events. Commissioner Robert Baer is questioning who will be collecting the funds for the wrist bracelets. City Administrator Dustin Dassinger states these details will be worked out a later date. Mr. Bernie Marsh is excited about this event license. He questions the security that will be needed for events. He is concerned on how long in the evening will the liquor license holder be responsible for the security in the event. City Administrator Dustin Dassinger states that this would be handled like a special event license. There will still be staff on the premises and it will depend on the event size and requirements for the event. Commissioner Jason Fridrich understands the security issue and feels this needs to be discussed prior to the bidding. Marketing and Events Director Joel Walters states there is only one band that is asking for additional security and that is Tiger Lily. City Administrator Dustin Dassinger stets that there will be additional police assigned to the performer. President Scott Decker is concerned of the open area and feels the city needs to be extra vigilant in the open area. He states the first year will be interesting and challenging. Mr. Bernie Marsh is wondering if the liquor license holder would be responsible for patrons during the event and after the event and would they license holder be done with security once the band is done or if when they would be done serving. City Administrator Dustin Dassinger states that this would be like any event that was held downtown such as Party on the Pavement. He states common sense would be that the license holder would not be expected to babysit the legacy square patrons. He states once the bid is selected the city will work with the operation side. Mr. Marcus Marsh questions whether wine would be able to be sold as it comes in plastic bottles and also if they would be able to sell out of the concession stand. City Administrator Dustin Dassinger states the concession stand would be able to be used and other points of sale. ORDINANCE NO. 1775 AN ORDINANCE AMENDING AND REENACTING ARTICLE 4.08 OF THE MUNICIPAL CODE OF THE CITY OF DICKINSON, NORTH DAKOTA, RELATING TO ALCOHOL LICENSES DISPOSITION: Roll call vote…Aye 5, Nay 0, Absent 0 Motion declared duly passed 2. To set a date for Special Commission Meeting to award the Legacy Square Concession License. Proposed date of June 15, 2023 at 1:00 p.m. City Administrator Dustin Dassinger states the bid closing date for the Legacy Square Liquor License is June 14, 2023 at 12:00 noon. Bid opening will be June 15, 2023 at 10:00 a.m. where bidders will be able to raise their bids. There will be a Special City Commission Meeting on June 15, 2023 at 1:00 p.m. for approval of the liquor license bid. This date and time will work for the Commissioners. 4.
